Rules, Regulations and Safety Guidelines
Who sets the rules?
The Minnesota Legislature provides guidance to licensed family
child care providers through various rules, regulations and safety
requirements.

The Family Child Care Licensing Rule
The primary set of rules, regulations and requirements for family
child care in Minnesota is Minnesota Rules, Parts
9502.0300-9502.0445, also known as the Family Child Care Rule,
Licensing Rule and Rule 2.

Additional Regulations
The Family Child Care Rule is supplemented by specific laws
passed by the Minnesota Legislature. Below you can view summaries of
applicable law from various sessions of the legislature. (In Adobe Acrobat format. You will need to have the free

- 2006 Session
- Syrup of ipecac is no longer required as of May 15, 2006.
- First Aid/CPR training for substitutes less than 30 hours in a
12 month period.
- Early Childhood Development training required for new
providers.
- Licensed child care providers must complete eight hours of
training each year.
- Family child care providers may use a mesh sided playpen or
crib that has not been identified as unsafe on the Consumer
Product Safety website.
- Changes to the crib safety standards and inspections.
- Provides that the set aside of a disqualification or variance
to a licenseholder is not public data if the subject is under 18
and the disqualification is for misdemeanor theft.
- Provides that the notice regarding a set-aside or variance
does not need to be given if it is for a juvenile under 18 and the
disqualification is for misdemeanor theft.
- 2005 Session
